Alabama Lemon Law for Cars, Trucks, and Vans for Personal Use

The Code of Alabama 1975, Title 8, Chapter 20A, Sections 1-6 is the state's new car Lemon Law. AL Lemon Law covers new passenger vehicles, SUVs, vans, trucks, and motorcycles that are purchased in Alabama within one year or 12,000 miles of the original delivery date of the vehicle (whichever comes first) and that have a manufacturer's gross vehicle weight rating of under 10,000 pounds. In order to be considered a "lemon," the vehicle must meet the following requirements:

  • Does not conform to the manufacturer's express warranty
  • Has substantial defects affecting the use, safety or value of the vehicle
  • Has manufacturer's defects that occurred during the first year from the original owner's delivery date or the first 12,000 miles on the odometer (whichever period ends first)
  • The problem was not a result of modifications made to the vehicle
  • Is mostly driven for personal, family, or household use
  • Has been taken in three times for the same problem or has been out of service for 30 business days for the same problem
  • The manufacturer has had a final opportunity to repair the vehicle
  • Was taken in for its first repair attempt before the first year or 12,000 miles; was taken in for its final repair before two years from the original delivery date or the first 24,000 miles on the odometer (whichever period ends first)
