What is a Lemon Car Under Alaska Lemon Law?

Alaska's Lemon Law is called the "Alaska Motor Vehicle Warranties Act," under Alaska Statute Section 45.45.300-360. Alaska Lemon Law covers new passenger vehicles, SUVs, vans, trucks, motorcycles and RVs that are purchased in Alaska for one year after the original purchase or during the period covered by the manufacturer's express warranty (whichever ends first). In order to be considered a "lemon," the vehicle must meet the following requirements:

  • Does not conform to the manufacturer's express warranty
  • Has substantial defects affecting the use, safety, or value of the vehicle
  • Has manufacturer's defects that occurred during the first year from the delivery date or during the period covered by the manufacturer's express warranty (whichever period ends first)
  • Has been taken in three times for the same problem or if it has been out of service for 30 business days for the same problem
  • After the dealer has tried to repair the vehicle three times, the manufacturer has been notified and given an opportunity to repair the vehicle
  • Is driven for personal use
