Demand Letter for Alaska Lemon Law Claims

If you go to court under the provisions of Alaska's Lemon Law, you must first send a Demand Letter to the manufacturer. The letter must be sent within 60 days after the express warranty has expired or the one-year time limit has been reached (whichever is first). The letter must include:

  • Your full name and address
  • A statement that the vehicle has a nonconformity
  • A statement describing the nonconformity
  • A statement that there have been three attempts to repair the problem
  • A statement demanding either a refund or a replacement vehicle be delivered on the 60th day following the mailing of your notice.

The Demand Letter must be sent by certified mail, with a return receipt requested.

Once you send the letter, the manufacturer or dealer has 30 days to make a final repair attempt before replacing your vehicle or giving you a refund.

Only manufacturers can be sued under Alaska's Lemon Law. Car dealers are not held liable for new car lemons.

Your dealer or repairing agent has made a reasonable number of attempts to conform the vehicle. I demand a [refund or replacement] be delivered to me on the 60th day after the mailing of this notice.
